WRONGFUL DEATH
If someone is injured as a result of negligence and dies as a result of those injuries, the Administrator of the Estate may bring a claim for wrongful death. The claim is brought on behalf of those family members who would be entitled to inherit from the Estate. North Carolina law allows a recovery for the economic loss that is incurred as a result of the death as well as a recovery for the conscious pain and suffering experienced by the deceased.
A wrongful death under North Carolina law is a death caused by a “wrongful act, neglect, or default” of another person, for which the injured individual could have recovered damages from the at-fault person, had the injured individual survived.
Circumstances in which a wrongful death can occur include but are not limited to the following:
- Car accident
- Premises liability accident
- Product liability accident
- Medical malpractice
